If you do not agree with these Terms and Conditions, you should not access or use our websites, mobile applications, or any other products or services offered by IQ Auto Glass® (collectively, the “Services”).
The Services are offered and available to users who are 16 years of age or older. By using this Website, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.
IQ Auto Glass®, LLC reserves the right to update or modify these Terms and Conditions at any time and for any reason. Any changes will be effective immediately upon posting, unless otherwise noted. However, any changes to the provisions set forth in Governing Law and Jurisdiction (section 24 below) will not apply to any disputes for which the parties have actual notice on or prior to the date the change is posted on the Services.
Your continued use of the Services following posting of revised Terms and Conditions means that you accept and agree to the changes.
You are encouraged to periodically review this Terms and Conditions to stay informed of updates unless you waive the right to receive specific notice of each such change or modification.

Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

- Application means the software program provided by the Company downloaded by You on any electronic device, named IQ Auto Glass®
- Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the Application has been downloaded.
- Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- Account means a unique account created for You to access our Service or parts of our Service.
- Country refers to: California, United States
- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to IQ Auto Glass®, LLC, 2098 Market St. Concord, CA 94520.
- Content refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.
- Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

- Free Trial refers to a limited period of time that may be free when purchasing a Subscription.
- Goods refer to the items offered for sale on the Service.

- Service refers to the Application or the Website or both.
- Subscriptions refer to the services or access to the Service offered on a subscription basis by the Company to You.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 16. The Company does not permit those under 16 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Placing Orders for Goods
By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.
Your Information
If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.
By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.
Order Cancellation
We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:
- Goods availability
- Errors in the description or prices for Goods
- Errors in Your Order
We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.
Your Order Cancellation Rights
Any Goods you purchase can only be returned in accordance with these Terms and Conditions and Our Returns Policy.
Our Returns Policy forms a part of these Terms and Conditions. Please read our Returns Policy to learn more about your right to cancel Your Order.
Your right to cancel an Order only applies to Goods that are returned in the same condition as You received them. You should also include all of the product’s instructions, documents and wrappings. Goods that are damaged or not in the same condition as You received them or which are worn simply beyond opening the original packaging will not be refunded. You should therefore take reasonable care of the purchased Goods while they are in Your possession.
We will reimburse You no later than 14 days from the day on which We receive the returned Goods. We will use the same means of payment as You used for the Order, and You will not incur any fees for such reimbursement.
You will not have any right to cancel an Order for the supply of any of the following Goods:
- The supply of Goods made to Your specifications or clearly personalized.
- The supply of Goods which according to their nature are not suitable to be returned, deteriorate rapidly or where the date of expiry is over.
- The supply of Goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
- The supply of Goods which are, after delivery, according to their nature, inseparably mixed with other items.
- The supply of digital content which is not supplied on a tangible medium if the performance has begun with Your prior express consent and You have acknowledged Your loss of cancellation right.
Availability, Errors and Inaccuracies
We are constantly updating Our offerings on the Goods and Service. Our Goods or Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods on the Service and in Our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Posted Information Reliability
The information presented on or through the Services is provided solely for general informational purposes. IQ Auto Glass® makes no representations or warranties, express or implied, as to the accuracy, completeness, or usefulness of any such information. Any reliance you place on such information is strictly at your own risk. IQ Auto Glass® disclaims all liability and responsibility arising from any reliance placed on such materials by you or any other user of the Services, or by anyone who may be informed of any of its contents.
The Services may contain content provided by third parties, including materials supplied by other users and third-party licensors. All statements and/or opinions expressed in such materials, and all articles, responses to questions, and other content, other than content provided directly by IQ Auto Glass® are solely the opinions and the responsibility of the person or entity providing such materials. These materials do not necessarily reflect the opinion of IQ Auto Glass®. IQ Auto Glass® is not responsible or liable to you or any third party for the content or accuracy of any materials provided by third parties.
Prices Policy
The Company reserves the right to revise its prices at any time prior to accepting an Order or Services.
The prices quoted may be revised by the Company subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties (e.g. tariffs), increased shipping charges, higher foreign exchange costs and any other matter beyond the control of the Company. In that event, You will have the right to cancel Your Order.
Payments
IQ Auto Glass® offers several different purchase options for use of the Services subject to a one-time payment. Payment can be made through major debit and credit card payment methods we have available, such as Visa, MasterCard, Affinity Card, American Express, Discovery cards or online payment methods (Apple Pay, Google Pay and PayPal, for example). You represent and warrant to IQ Auto Glass® that any payment information you provide to IQ Auto Glass® is true and correct that you are authorized to use such payment account. You agree to promptly update your account information with any changes that may be necessary (for example, a change in your billing address or credit card expiration date).
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.
Credit-Card Payment Policy
IQ Auto Glass® accepts payment by credit card, debit card, cash or approved company check. Customers who choose to pay by credit card will be charged a 3% credit-card processing fee. This fee reflects the cost imposed by our payment processor and will be clearly disclosed prior to payment.
This fee is not mandatory, and customers may avoid it by selecting any non-credit-card payment method accepted by IQ Auto Glass®. All prices quoted in estimates, invoices, or service documents represent the total amount due, including the applicable processing fee when paying by credit card, in accordance and compliance with California’s “Honest Pricing Law” (SB 478).
By submitting payment via credit card, the customer acknowledges and agrees to the stated 3% processing fee. Customers who prefer not to incur this fee must choose an alternative form of payment at the time of service.
Refund Policy
Please note that all fees paid are non-refundable. However, at our sole discretion, we may occasionally choose to offer a one-time refund, discount, or other form of credit. This is done as a courtesy and does not guarantee or entitles you to future credits or refunds under similar circumstances.

Cancellations
For prepaid services booked through our website, payment link, at the shop, or in rare cases over the phone, a cancellation fee (plus applicable taxes) may apply if the service is fully cancelled. In such cases, you will receive a refund equal to your original payment minus the cancellation fee.
Deposits
If a deposit is made to book a service through our website, payment link, at the shop, or in rare cases over the phone, please note that the deposit (plus applicable taxes) is non-refundable if you fail to show up for your appointment or cancel without providing at least 24 hours’ notice.
You may reschedule your service at any time, In the event that more than 24 hours have elapsed from the originally scheduled appointment time, a new non-refundable deposit shall be required, irrespective of whether notice of rescheduling has been provided.
When a customer places an order for Goods through our website, payment link, in-store, or—on rare occasions—by phone, a deposit (including applicable taxes) is required. All deposits are strictly non-refundable once the order has been placed, except in the following circumstances:
- The Goods become unavailable, or
- The Goods are determined to be damaged or not in acceptable condition in the case of used Goods.
If a customer chooses to cancel the order for any reason unrelated to the Goods’ availability or condition—including, but not limited to, finding a better price elsewhere or deciding not to proceed—the deposit will not be refunded and will be considered forfeited.
Vehicle Pickup and Garage Keeping Fee
IQ Auto Glass® will notify the customer promptly once the service has been completed and the vehicle is ready for pickup. The customer is required to pick up the vehicle upon receiving such notification, or on or before the closure of the shop’s business hours.
If the vehicle is not picked up during the shop’s business hours, IQ Auto Glass® reserves the right to charge an additional garage keeping fee of up to $50.00/day if the vehicle remains in the shop’s garage.
In the event that the vehicle is not picked up and no garage space is available, the vehicle will be parked outside. In such cases, the garage keeping fee will be waived. However, IQ Auto Glass® shall not be held liable for any damage, loss, or theft that may occur if the vehicle is parked outside.
Subscriptions
Subscription period
The Service or some parts of the Service are available only with a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as daily, weekly, monthly or annually), depending on the type of Subscription plan you select when purchasing the Subscription.
At the end of each period, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Company cancels it.
Subscription cancellations
You may cancel Your Subscription renewal either through Your Account settings page or by contacting the Company. You will not receive a refund for the fees You already paid for Your current Subscription period and You will be able to access the Service until the end of Your current Subscription period.
Billing
You shall provide the Company with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information.
Should automatic billing fail to occur for any reason, the Company will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
Fee Changes
The Company, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period.
The Company will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes Your agreement to pay the modified Subscription fee amount.
Refunds
Except when required by law, paid Subscription fees are non-refundable.
Certain refund requests for Subscriptions may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company.
Free Trial
The Company may, at its sole discretion, offer a Subscription with a Free Trial for a limited period of time.
You may be required to enter Your billing information in order to sign up for the Free Trial.
If You do enter Your billing information when signing up for a Free Trial, You will not be charged by the Company until the Free Trial has expired. On the last day of the Free Trial period, unless You canceled Your Subscription, You will be automatically charged the applicable Subscription fees for the type of Subscription You have selected.
At any time and without notice, the Company reserves the right to (i) modify the Terms and Conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
Promotions
Any Promotions made available through the Service may be governed by rules that are separate from these Terms.
If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.
From time to time, IQ Auto Glass® may, at its sole discretion, issue promotional codes (“Promo Codes”) that may be used to access the Services at a reduced cost. Promo Codes are non-transferable, have no cash value, and are intended for your personal use only. You agree not to sell, transfer, or share Promo Codes with any third party, including by posting them publicly on websites or social media. Promo Codes may be subject to expiration or other limitations as specified at the time of issuance. IQ Auto Glass® reserves the right to modify, deactivate, or revoke any Promo Code at any time, for any reason, without prior notice.
User Accounts
When You create an account with Us and regardless of whether you register with us or use the Services as a guest, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.
You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
We reserve the right, in our sole discretion, to disable, suspend, or terminate any username, password, or other account credentials, whether selected by you or assigned by us, at any time and for any reason, including, without limitation, if we believe you have violated any provision of these Terms and Conditions. We are not obligated to provide prior notice or explanation for such action.
Content
We reserve the right, at our sole discretion, to modify, suspend, or discontinue any aspect of the Services, including but not limited to any content, information, features, or other materials provided through or in connection with the Services (“Service Content”), at any time and without prior notice. We shall not be liable for any reason if all or any portion of the Services or Service Content becomes unavailable at any time or for any duration. We may, from time to time, restrict access to some or all parts of the Services or Service Content at our discretion.
Your Right to Post Content
Our Service allows You to post Content. You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service without further notice to or consent from you, and without payment to you or any person or entity.. You retain any and all of Your rights to any Content You submit, post or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to these Terms.
You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. (iii) You shall not contain unlawful, defamatory, obscene, harassing, or otherwise objectionable material; shall not infringe any intellectual property, privacy, or other rights of any person; and shall at all times comply with these Terms and Conditions and all applicable laws.
Unsolicited Ideas Policy
Except where we have expressly requested submissions and such submissions are subject to specific additional terms, it is our policy not to accept or consider any unsolicited ideas, suggestions, proposals, creative works, or other materials (“Unsolicited Submissions”). This policy is intended to avoid any potential misunderstandings or disputes in the event that materials developed by IQ Auto Glass® appear similar to your Unsolicited Submissions.
Accordingly, we assume no responsibility for reviewing, considering, or responding to any Unsolicited Submissions. If, despite this policy, you choose to send us any Unsolicited Submissions, you hereby agree that:
- (a) such submissions are not confidential or proprietary;
- (b) we are under no obligation to acknowledge, review, or compensate you for them; and
- (c) we are free to use, reproduce, modify, disclose, distribute, or otherwise exploit such submissions in any manner and for any purpose, without restriction or liability to you.
Content Restrictions
The Company is not responsible for the content of the Service’s users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under Your account, whether done so by You or any third person using Your account.
You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:
- Unlawful or promoting unlawful activity.
- Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
- Spam, machine – or randomly – generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
- Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.
- Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights.
- Impersonating any person or entity including the Company and its employees or representatives (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing).
- Violating the privacy of any third person.
- False information and features.
- To exploit, harm, or attempt to exploit or harm minors in any way, including, without limitation, by exposing them to inappropriate content, soliciting personally identifiable information,
- Engage in any conduct that restricts, inhibits, or interferes with any other individual’s use or enjoyment of the Services or Service Content, or that, in the judgment of IQ Auto Glass® ™, may cause harm to IQ Auto Glass® ™, its users, or expose any of them to legal liability.
- Use the Services in any way that could disable, overburden, damage, or impair the Website or otherwise interfere with any other party’s use of the Services, including their ability to participate in real-time interactions via the Services.
- Use any manual process, device, program, or means to access, acquire, monitor, or copy any portion of the Services or Service Content, or for any other purpose not expressly authorized in these Terms, without our prior written consent.
- Attempt to gain unauthorized access to, interfere with, damage, disrupt, or otherwise compromise the security, integrity, or proper functioning of any part of the Services, the servers on which the Services or Service Content are stored, or any server, computer system, network, or database connected to the Services.
- Transmit, or procure the sending of, any unauthorized advertising, promotional, or marketing materials, including but not limited to “junk mail,” “chain letters,” “spam,” or any other form of unsolicited or unauthorized solicitation, whether commercial or otherwise.
The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. The Company further reserves the right to make formatting and edits and change the manner of any Content. The Company can also limit or revoke the use of the Service if You post such objectionable Content. As the Company cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.
Content Backups
Although regular backups of Content are performed, the Company does not guarantee there will be no loss or corruption of data.
Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.
The Company will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Company has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.
You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.
Mobile Access and Charges
If you access the Services via a mobile device, please be aware that your wireless carrier’s standard messaging, data, and other rates and fees may apply. Certain features, services, or applications may be restricted or prohibited by your carrier, and not all services may be compatible with all devices or networks.
If you change or deactivate your mobile phone number, you agree to promptly update your account information to ensure we can continue to communicate with you effectively.
Mobile Messages Consent Clause
By providing your mobile telephone number, you consent to receive periodic SMS and/or MMS messages from IQ Auto Glass®, which may include, but are not limited to, service-related notifications, updates, promotional offers, and other communications.
By participating in the SMS/MMS messaging service (“Messaging Service”), you agree to these Terms and our Privacy Policy. Message frequency may vary. Standard message and data rates may apply. You understand that your consent to receive such messages is not a condition of purchasing any goods or services. You may opt out of receiving messages at any time by following the instructions provided in the messages or as described in our Privacy Policy.
By opting in, you agree that IQ Auto Glass® may send you SMS/MMS messages using autodialer or non-autodialer technology to the mobile number you provide. Consent is not required to make a purchase.
You confirm that you own or are authorized to use the number you provide and consent to electronic records documenting your opt-in. Message and data rates may apply. We may collect and use information (such as your phone number, carrier, and message data) to manage and improve our messaging service, which we may change or end at any time without notice.
1.1 Charges and Carriers
Message and data rates may apply. Please check your mobile plan for details. You are responsible for any charges resulting from your use of the SMS/MMS Service.
The Service may not be supported by all carriers. Supported carriers include major U.S. providers such as AT&T, T-Mobile®, Verizon Wireless, Sprint, and others. IQ Auto Glass® and participating carriers are not responsible for delays, delivery failures, or message errors.
1.2 To Stop/Opt Out the SMS/MMS Service
To stop receiving messages, reply STOP/Opt Out to any text you receive from IQ Auto Glass®. For services using a different number, send STOP/Opt Out to that number. You may receive a confirmation or clarification message. Opt-out requests will be honored as soon as reasonably possible. These Terms continue to apply after you opt out. You further understand and agree that any opt-out request may not take effect immediately but will take effect as soon as possible within the limitations of the Our systems.
1.3 Help and Questions
For help, text HELP by contacting us at IT@iqautoglass.com. We will reply with instructions on how to use or unsubscribe from the service.
1.4 Mobile Number Changes
If you change or deactivate your mobile number, please notify us promptly at ITAdmin@iqautoglass.com to avoid messages being sent to the wrong recipient.
1.5 Data and Message Frequency
Message and data rates may apply. Message frequency may vary. Delivery depends on your carrier’s network and cannot be guaranteed. IQ Auto Glass® and carriers are not responsible for delays or undelivered messages.
Copyright Policy
Intellectual Property Infringement
We respect the intellectual property rights of others. It is Our policy to respond to any claim that Content posted on the Service infringes a copyright or other intellectual property infringement of any person.
If You are a copyright owner, or authorized on behalf of one, and You believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, You must submit Your notice in writing to the attention of our copyright agent via email at legal@iqautoglass.com and include in Your notice a detailed description of the alleged infringement.
You may be held accountable for damages (including costs and attorneys’ fees) for misrepresenting that any Content is infringing Your copyright.
DMCA Notice and DMCA Procedure for Copyright Infringement Claims
You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright’s interest.
